Terms and Conditions

1770 4x4 TOURS
TERMS AND CONDITIONS

  1. ABOUT THESE TERMS

These Terms and Conditions apply to bookings and participation in tours, experiences, activities, private experiences, customised experiences and other services supplied by 1770 4x4 Tours.

1770 4x4 Tours operates from Agnes Water and the Town of 1770, Queensland, Australia.

Legal entity: Galangarri Pty Ltd

Trading name: 1770 4x4 TOURS

ABN: 78696547574

Website: 17704x4tours.com.au

Email: 1770tours@proton.me

In these Terms, “we”, “us”, “our” and “Operator” mean the legal entity trading as 1770 4x4 Tours.

“Participant” means any person taking part in an experience.

“Customer” means the person making or paying for the booking.

  1. ACCEPTANCE OF THESE TERMS

By making a booking, paying a deposit or other amount, accepting a booking confirmation, clicking an online acceptance box or participating in an experience, the Customer agrees to these Terms and Conditions.

A person making a booking on behalf of other Participants must provide these Terms to those Participants.

Each adult Participant may be required to separately acknowledge relevant safety information and risks before participating.

A parent or legal guardian must accept applicable participation and risk conditions for a child in their care.

  1. AUSTRALIAN CONSUMER LAW

Our services come with rights and consumer guarantees under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or protection that cannot lawfully be excluded, restricted or modified.

If any part of these Terms is inconsistent with a right that cannot legally be excluded, the law will prevail to the extent of that inconsistency.

  1. BOOKINGS

A booking is confirmed when:

a. we accept the booking;

b. any required deposit or payment has been received; and

c. a booking confirmation has been issued.

Bookings remain subject to availability.

Customers must provide accurate contact information and any information reasonably required for the safe and appropriate delivery of the booked experience.

  1. PRICES AND PAYMENT

All prices are in Australian dollars.

Prices include GST where GST is applicable.

The price applicable to a booking will be the price disclosed to the Customer before the booking is confirmed.

Any booking fee, card surcharge, third-party charge or other additional charge will be disclosed before payment where required by law.

We will not add undisclosed charges after a booking has been confirmed.

Custom, private and ceremony experiences may require an individually quoted price.

  1. CUSTOMER CANCELLATIONS

Customers may cancel a booking by contacting 1770 4x4 Tours using the contact details provided with their booking details.

Where a Customer cancels within 24 hours will not be refunded. Outside of this time frame, a  change of mind, any cancellation amount retained by us will be limited to an amount reasonably reflecting costs and losses arising from the cancellation, subject to applicable law.

When determining a cancellation amount, we may take into account:

a. reasonable administration and booking costs;

b. non-refundable costs already reasonably incurred specifically for the booking;

c. reasonable third-party costs;

d. the notice provided before departure; and

e. whether the cancelled place can reasonably be resold.

Where we are able to resell the cancelled place for the same price, any amount retained will be limited to reasonable unrecoverable costs associated with the original booking.

Where appropriate, we may offer a transfer, rescheduled booking or credit instead of cancellation.

Nothing in this clause limits any refund or other remedy available under the Australian Consumer Law.

  1. CHANGES REQUESTED BY CUSTOMERS

Requests to change a booking date, Participant name, tour or other booking details are subject to availability.

Any additional cost will be disclosed before the change is confirmed.

  1. CANCELLATIONS BY 1770 4x4 TOURS

Safety comes before itinerary.

We may cancel or postpone an experience when reasonably necessary because of circumstances including:

a. unsafe weather;

b. road, beach, track or national park closures;

c. tides or environmental conditions;

d. fire, flood, storm or natural events;

e. government or emergency service directions;

f. mechanical or vehicle issues;

g. illness or an emergency affecting the guide;

h. insufficient participant numbers where a minimum number was clearly disclosed before booking; or

i. circumstances outside our reasonable control that prevent the experience from safely or lawfully operating.

If we cancel an experience before it begins and cannot provide the booked service, the Customer will be offered, as appropriate:

a. a transfer to another available date;

b. a credit acceptable to the Customer; or

c. a refund of the amount paid for the cancelled service.

Any rights available under the Australian Consumer Law continue to apply.

Unless required by law, 1770 4x4 Tours is not responsible for costs independently booked with other providers, such as accommodation, flights, vehicle hire or onward transport.

Customers are encouraged to consider appropriate travel insurance.

  1. ITINERARY AND EXPERIENCE CHANGES

1770 4x4 Tours operates in natural environments where access and conditions can change.

Locations, routes, departure times and activities may be changed when reasonably necessary because of safety, weather, access, tides, environmental conditions, park management requirements or other legitimate operational reasons.

Where reasonably possible, we will provide a comparable alternative experience.

If we make a material change before departure that substantially changes the main purpose of the booked experience, the Customer may contact us to discuss an alternative date, alternative experience or refund.

Minor reasonable itinerary changes do not automatically entitle a Customer to a refund where the essential booked service can still be provided.

  1. WEATHER, WILDLIFE AND NATURAL CONDITIONS

Our experiences take place in natural environments.

Weather, tides, ocean conditions, wildlife, water levels, vegetation, track conditions, visibility, sunsets, sunrises and night-sky conditions are outside our control.

Wildlife sightings are never guaranteed.

Stargazing, swimming, fishing, body surfing and other condition-dependent activities may be modified, relocated or omitted where conditions are unsuitable.

We will not represent a naturally occurring event or wildlife sighting as guaranteed unless it genuinely is guaranteed.

  1. ARRIVAL AND DEPARTURE

Customers must arrive at the confirmed meeting point at the time stated in their booking information.

Experiences may need to depart at the scheduled time.

A Participant who arrives too late to safely or reasonably join the experience may be treated as having cancelled.

Any amount retained in those circumstances will be subject to these Terms, our reasonable loss and costs, and applicable Australian law.

  1. PARTICIPANT SUITABILITY

Different experiences have different physical requirements.

Customers and Participants are responsible for reading the suitability information supplied for their chosen experience.

Participants must tell us before the experience about any relevant mobility issue, injury, medical condition or other circumstance that may materially affect their ability to safely participate.

This information allows us to discuss whether an experience is suitable and whether reasonable adjustments may be possible.

We may refuse or discontinue participation where there are reasonable safety grounds for doing so.

Where an experience has particular physical requirements, including balance, strength, walking ability or swimming considerations, these requirements will be communicated as clearly as reasonably possible.

Nothing in these Terms permits unlawful discrimination.

  1. BLACKMANS GAP AND PHYSICALLY DEMANDING EXPERIENCES

Some experiences involve greater physical demands than others.

Blackmans Gap, for example, may involve granite boulders, uneven natural surfaces, creek areas and moderate physical challenge.

Participants booking physically demanding experiences must carefully consider the stated fitness, strength, mobility and balance requirements.

The Operator may determine that participation should not proceed where conditions or a Participant's circumstances create an unreasonable safety risk.

  1. CHILDREN

Children must be accompanied and supervised by a responsible parent or guardian unless expressly agreed otherwise.

The parent or guardian remains responsible for appropriate supervision of children throughout the experience.

All passengers must comply with applicable Queensland vehicle restraint and road safety requirements.

Parents and guardians must provide accurate ages and other information reasonably requested when booking.

Any tour-specific minimum age or suitability requirement will be disclosed where applicable.

  1. PARTICIPANT CONDUCT

Participants must:

a. follow reasonable safety directions from the Eco Tour Guide;

b. remain within designated or instructed areas;

c. respect wildlife, national parks, beaches, waterways, other visitors and local environments;

d. use supplied safety equipment as instructed;

e. wear seatbelts and other restraints where required;

f. not deliberately damage vehicles, equipment or property;

g. not behave in a threatening, abusive, dangerous or seriously disruptive manner; and

h. not participate while materially impaired by alcohol or drugs.

We may refuse or discontinue participation where a Participant's behaviour creates a genuine safety risk, seriously disrupts the experience or places people, wildlife, property or the environment at risk.

Any cancellation or payment consequence arising from such conduct will be determined reasonably and subject to Australian law.

  1. 4X4 AND REMOTE AREA RISKS

1770 4x4 Tours provides experiences that may involve travel and activities in remote and natural environments.

Depending on the experience, Participants may encounter risks including:

a. travel in a 4WD vehicle;

b. unsealed roads and tracks;

c. sand tracks and beach environments;

d. uneven, slippery, rocky or unstable surfaces;

e. vehicle movement over rough terrain;

f. remote locations;

g. changing weather;

h. heat and sun exposure;

i. insects and wildlife;

j. ocean, creek, estuary or water hazards;

k. tides and waves;

l. slips, trips and falls;

m. tree branches and natural obstacles; and

n. reduced access to immediate medical assistance or mobile telephone coverage.

Participants acknowledge that outdoor and recreational activities contain inherent risks that cannot always be completely eliminated.

Participants agree to exercise reasonable care for their own safety and follow reasonable instructions given by the Eco Tour Guide.

This risk acknowledgement does not exclude any duty, consumer guarantee or liability that cannot lawfully be excluded.

  1. RECREATIONAL ACTIVITIES

Certain experiences supplied by 1770 4x4 Tours may constitute recreational activities or recreational services under Australian or Queensland law.

Some recreational activities inherently involve physical risks.

Nothing in these Terms is intended to exclude liability where Australian or Queensland law prohibits that liability from being excluded, including liability arising from conduct that cannot lawfully be protected by a contractual exclusion.

Where a separate activity-specific risk acknowledgment or waiver is required, it will form part of the participation requirements for that particular activity.

  1. WATER-BASED ACTIVITIES

Some experiences may involve swimming, ocean activities, body surfing, canoeing, boating or other activities in or near water where applicable.

Participation may depend on weather, tides, water conditions, Participant ability and the judgment of the guide.

Participants must follow all reasonable water-safety instructions.

A Participant must not enter the water if instructed not to do so.

The availability of a water activity on a particular day is not guaranteed.

  1. PERSONAL BELONGINGS

Participants are responsible for personal belongings brought on an experience.

We recommend that valuables be kept secure and that items vulnerable to water, sand, dust or impact are appropriately protected.

To the extent permitted by law, we are not responsible for loss or damage to personal property that was not caused by our failure to exercise reasonable care.

  1. DAMAGE CAUSED BY PARTICIPANTS

A Participant may be responsible for reasonable repair or replacement costs where they intentionally, recklessly or negligently damage our vehicle, equipment or property.

We will not impose an arbitrary penalty.

Any amount claimed will reasonably relate to the actual loss or damage caused.

  1. PHOTOGRAPHY AND VIDEO

We may take photographs or video during experiences.

We will seek appropriate consent before using an identifiable Participant's image for advertising, promotional or marketing purposes.

Consent for marketing use is voluntary.

Consent from a parent or guardian will be required for identifiable marketing images of children where required.

A Participant may tell the guide that they do not wish to appear in promotional content.

  1. THIRD-PARTY PROVIDERS

Some experiences may involve or recommend services supplied by independent businesses, such as cafés, restaurants, accommodation providers, marine operators or other tourism businesses.

Where a third party directly provides a service, that provider may have its own terms and conditions.

1770 4x4 Tours does not exclude responsibility that the law places on us for services we sell, arrange or represent as part of our own service.

Where we merely recommend an independent third-party business and the Customer separately contracts with that business, the third party is responsible for its own service, subject to applicable law.

  1. GIFT VOUCHERS

Gift cards and gift vouchers issued by 1770 4x4 Tours will comply with applicable Australian Consumer Law requirements.

Where the statutory minimum validity period applies, a gift card or gift voucher will be redeemable for at least three years from the date it is supplied.

Any expiry date or applicable redemption conditions will be clearly stated.

Nothing in this clause prevents a legally permitted exception from applying to a particular promotional or discounted voucher.

  1. PROMOTIONS AND SPECIAL OFFERS

Promotional offers may have additional conditions, provided those conditions are disclosed clearly before purchase.

Promotional conditions do not remove rights available under the Australian Consumer Law.

Offers are subject to genuine availability and will not use false scarcity.

  1. PRIVATE TOURS, CUSTOM EXPERIENCES AND CEREMONIES

Private tours, customised experiences and ceremony experiences may have additional agreed requirements because they are individually planned.

Any additional terms, inclusions, prices, deposits, third-party expenses or cancellation arrangements will be disclosed before the booking is confirmed.

Ceremony services provided by Hollie-Berri in a celebrant capacity may also be subject to a separate Celebrant Service Agreement.

Where a legal marriage ceremony is being provided, applicable Australian marriage law and celebrant obligations prevail over any inconsistent tourism-related term.

Symbolic ceremonies do not themselves create a legal marriage unless all applicable legal marriage requirements are separately satisfied.

  1. ECO GUIDE AND ENVIRONMENTAL RESPONSIBILITY

Participants must comply with reasonable directions intended to protect the natural environment, wildlife, national parks, beaches and other places visited.

Participants must not intentionally disturb wildlife, remove protected natural material, damage vegetation, leave rubbish or undertake conduct prohibited by law or park requirements.

Access to particular locations is always subject to lawful access arrangements, conditions and applicable park or land-management requirements.

  1. PRIVACY

Personal information will be collected, used and stored only for legitimate purposes connected with bookings, customer communication, safety, business administration and other purposes permitted by applicable law.

Relevant medical or accessibility information provided for safety purposes will only be used and disclosed as reasonably necessary for the experience or where otherwise permitted or required by law.

Our separate Privacy Policy, where published, should be read together with these Terms.

  1. COMPLAINTS

If a Customer has a concern about an experience, we encourage them to raise it with us as soon as reasonably possible so we have an opportunity to understand and address the issue.

Complaints can be made using the contact details provided in these Terms or the booking confirmation.

Nothing in this clause limits a Customer's right to contact Queensland's Office of Fair Trading, the Australian Competition and Consumer Commission or another appropriate dispute-resolution or legal body.

  1. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

To the maximum extent permitted by law, 1770 4x4 Tours will not be liable for loss caused solely by:

a. the Customer's or Participant's own act or omission;

b. failure to follow reasonable safety instructions;

c. an inherent natural risk not caused by our failure to exercise required care;

d. an independent third party for whose conduct we are not legally responsible; or

e. circumstances for which applicable law does not impose liability on us.

This clause must be read subject to the Australian Consumer Law and all applicable Queensland laws.

  1. EVENTS OUTSIDE REASONABLE CONTROL

Neither party will be treated as breaching these Terms merely because performance is prevented by an event genuinely outside that party's reasonable control, subject to any rights and remedies provided by law.

Such events may include natural disasters, severe weather, fires, floods, government restrictions, emergency closures and similar events.

Where such an event prevents us from providing the booked experience, we will communicate with affected Customers and provide the remedies required by the contract and applicable law.

  1. CHANGES TO THESE TERMS

The Terms applying to a booking are generally the Terms provided or made available when that booking is made.

We may update these Terms for future bookings.

We will not retrospectively impose a material change on an existing booking merely by changing the Terms on our website.

Changes to an existing booking may be made where required by law or agreed between the parties.

  1. SEVERABILITY

If a provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down or severed to the extent necessary.

The remaining provisions will continue to operate where they are capable of doing so.

  1. GOVERNING LAW

These Terms are governed by the laws of Queensland and the Commonwealth of Australia as applicable.

Subject to any legal right a Customer has to bring proceedings elsewhere, the parties submit to the jurisdiction of the courts and tribunals of Queensland.

Nothing in this clause limits any jurisdictional right that cannot lawfully be excluded.

  1. ENTIRE BOOKING AGREEMENT

The booking agreement may include:

a. these Terms and Conditions;

b. the booking confirmation;

c. the description and inclusions of the booked experience;

d. any specific conditions disclosed before booking;

e. any agreed custom itinerary or quotation; and

f. any applicable activity-specific risk acknowledgment.

Nothing in this clause excludes rights arising from representations or conduct where Australian law provides otherwise.
